How do you get a High School expulsion reversed?

A junior in high school got expelled for pointing a b-b gun at another kid in town (not at school). His criminal charge was pointing a gun with intent to injure. He’s basically a good kid, and has a job and good grades. He made a bad judgement. In this instance he was being bullied and foolishly chose the wrong response to take.

Any ideas? ?? We thought his football coach or a favorite teacher could put in a good word for him.

He has no contact with his father, and his mother really doesn’t care about him.

Anyone ever have a similar situation?

There is an appeal process for expulsion, but there is usually a deadline for filing. Point of thought: If he pointed a BB gun at an individual, what is to deter him to pointing a real gun. There needs to be a consequence, if there isn’t chances are there are going to be harder times down the road.

The reason for the punishment at school for the incident outside of school; if he was cited by the police and it is the school’s duty to enforce criminal activity that flows from the streets into the school system. Remember, you may have another set of parents who think of this child in a different view that you. They want their children to be safe.

If you need to get an attorney. Make sure you have someone who has practiced school law.

See if you can get a lawyer to pro-bono take the case and check the legality of expelling a student for a non- school related incident. Check with the ACLU

I’m not sure it can be reversed, unless he’s in Special Education, in which case he has special rights.

He can still get an education in several ways:

1) home schooling

2) ask in a nearby district, to be admitted

3) go to a private school, for a year

4) apply to a charter school in the area

5) check on alternative schools, in the area
