You should never loan anyone money unless you are unable to withstand not getting repaid. Also loaning money to a friend may lead to the end of the friendship. Generally all loans should have the loan in writing. You can even get a form for that at a good stationary store.
That said approach the debtor and ask him outright why the loan has not been paid. have the person suggest the ways in which he proposes to pay the loan. Be prepared to offer him some options such as a certain amount each week or month, your obtaining something else that is of value.
Do not threaten to go to small claims unless you are ready to do so. Also even if you get a judgment it is frequently impossible to secure payment.

A phone call to discuss the situation would be a start. If you can’t come to some resolution or at least a viable payment plan, then I’d send a certified letter laying out when you expect to be paid in full before taking that person to small claims court…if that’s a step you want to take. Sometimes it’s more important to let the money go and learn a lesson.

Are you in debt or does somebody you know owe you money? If the person owes you money and they haven’t paid you back, you could sue them. If you’re talking about you’re in debt, then ask a friend/mom/dad to loan you money. If not, you’re going to have to file for bankruptcy.
