overtime question?

Your employees have been incurring alot of overtime lately for staffing special events. You cannot afford to pay time-and-a-half for overtime so you make a deal with them: if they work 50 hrs this week you will let them work 30 hrs the next week, and take a long weekend. They are happy and you are happy.

Is this acceptable? What can happen if you get caught doing this?

If it’s something that you both agree upon I guess it’s ok, but I dont see how that would really work…if you need them to stay late a lot, who’s to say you won’t need them as much next week? If you get caught you may be in trouble with the labor board, but if everyone’s ok with it, then who will tell?

Do the employees in question belo ng to a union? If not, what are the terms of their contracts? What you are proposing is (presumably) based on a 40 hour work week. That means you are paying them ten hours of overtime the first week, but shorting them 10 hours of regular pay the second week. But, unless what you are proposing flies in the face of prior agreements, and if the employees are willing to do it, there shouldn’t be any problem.

no buy law u have to pay them over time no matter what the cost is is a goverment if you don’t pay any overtime one of the enployees wit sue you and the comany for a lot of money and they will win the case
